If you are a living individual residing in the United States who was sent notice by Benworth Capital Partners LLC (“Defendant”) that your Private Information may have been impacted during the Data Incident involving Benworth that occurred on or about May 18, 2025, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (a) all persons who are directors, officers, and agents of Defendant; (b) governmental entities; and (c) the Judge assigned to the lawsuit, that Judge’s immediate family, and Court staff; (d) any Settlement Class Member who properly opts out of the Settlement; and (e) Joseph Boggan.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by December 21, 2026.

If you are a member of the Settlement Class, you may be eligible for the following Settlement Class Member Benefits

Credit Monitoring. All Class Members will automatically receive one (1) year of free Credit Monitoring. Enrollment codes have been provided to all Class Members on their Settlement Notice. If you no longer have your enrollment code, please contact the Administrator. Please keep your notice, as you will only be able to activate the free Credit Monitoring after final settlement approval.

Cash Payment Option 1 - Documented Losses. Class Members who incurred reasonable documented losses fairly traceable to the Data Incident, can get back up to $5,000.00. Examples of Documented Losses include (but are not limited to) unreimbursed losses relating to actual fraud or identity theft if:

  • the loss is an actual, documented, and unreimbursed monetary loss

  • the loss was more likely than not caused by the Data Incident

  • the loss was incurred after the date of the Data Incident

You need to submit documented proof, like telephone records, correspondence including emails, or receipts. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. If you do not submit reasonable documentation supporting your loss, or if the Settlement Administrator determines your Claim is incomplete, and you do not fix your Claim, your Claim will be denied.

You will not be reimbursed for expenses if you have been reimbursed for the same expenses by another source, including payment provided in connection with any credit monitoring and identity theft protection product.

Cash Payment Option 2 - Alternative Cash. Instead of the benefits in Cash Payment Option 1 - Documented Losses, Class Members may claim an estimated cash payment of $50.00.

The deadline to submit a Claim Form online is December 21, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than December 21, 2026.
